Chapter 7
A Chapter 7 Bankruptcy Filing does not involve any court protected repayment plan and will legally eliminate your unsecured dischargeable debt (i.e. credit cards, medical bills, most judgments and garnishment, repossession debt, eviction or broken lease debt, some taxes, past due utilities, etc..). The dept is eliminated through a legal discharge. A Chapter 7 discharge is not an absolute right, but most individuals experiencing financial difficulty will qualify.
You will still be required to continue making payments on those secured debts where you have decided to keep the collateral (house, car, furniture etc.). You will need to be current with your payments and in many cases the creditor will want a written agreement known as a reaffirmation agreement.
Chapter 13 - Reorganization and Debt Adjustment
Chapter 13 is a court protected repayment plan that allows the debtor to modify secured debt agreements and to eliminate a large amount of unsecured debt. The monthly payment required by Chapter 13 is based on the Debtor's ability to pay. Depending on values and types of debt, the Debtor's payments on the secured debts can actually by less per month than before. Tax obligations are payable under Chapter 13 and, in some situations, can result in the elimination of penalties and the discharge of taxes. Upon completion of the Chapter 13, the debtor receives a discharge of unpaid unsecured debts. A Chapter 13 can be for as long as 60 months if needed by the Debtor.
